Keep Packaging Artwork Adaptable
Plan the artwork changes now, but leave designs open to revision. Brands, retailers and e-commerce operators should map each packaging format's material composition, reuse status, deposit-return coverage and available label space.
Commission initiative 19243 covers harmonised pictograms and labelling specifications for packaging and waste receptacles. The planned implementing decision aims to help consumers sort waste, identify reusable and deposit-return packaging, and understand recycled or bio-based content.
The later-of formulas below mean delayed implementing acts may move compliance dates beyond the Regulation's headline dates. An artwork freeze based only on 12 August 2028 could therefore be premature. The labelling duties remain.
Manufacturers and importers remain responsible for conformity documentation. Distributors must withhold packaging they believe is non-compliant, as set out in Articles 15, 18 and 19.
Separate Deadlines For Each Label
Articles 12(6), 12(7) and 13(2) of Regulation (EU) 2025/40 required the Commission to adopt the packaging-label rules, digital material-composition methodology and waste-receptacle label rules by 12 August 2026.
The deadlines for using the labels follow different triggers:
- Material-composition labels. Required on packaging placed on the market from 12 August 2028 or 24 months after the relevant Article 12(6) or 12(7) implementing acts enter into force, whichever is later.
- Reusable-packaging labels. Required on packaging placed on the market from 12 February 2029 or 30 months after the Article 12(6) act enters into force, whichever is later. A QR code or other standardised open digital carrier must provide further reuse information.
- Waste-receptacle labels. Member States must ensure these are in place by 12 August 2028 or 30 months after adoption of the Article 13(2) acts, whichever is later. Receptacles subject to deposit-return systems are excluded.
For packaging labels, the clock runs from the acts' entry into force. For waste-receptacle labels, it runs from adoption.
Exclusions And Existing Stock
Article 12 treats these formats differently:
- Transport packaging. Excluded from the material-composition duty, except for e-commerce packaging.
- Deposit-return packaging. Excluded from that duty. Packaging subject to Article 50(1) must carry its own clear label.
- Open-loop reusable packaging without a system operator. Exempt from the reuse label and digital-carrier requirement.
- Specified medical and veterinary packaging. Exempt where other mandatory labels leave no space or packaging labels could jeopardise the safe use of human or veterinary medicines.
Article 12(12) provides a three-year stock transition. Packaging manufactured in the EU or imported before the applicable deadlines in Article 12(1), (2) and (4) may still be made available if it lacks the required labels. That permission lasts until three years after the relevant labelling requirements enter into force.
